Nursing
home negligence:
When an injury occurs
to a nursing home resident, the physical, emotional, and economic
consequences can be devastating. Our courts
have declared that a nursing home's function is "to provide care for
those who are unable, because of physical or mental impairment, to
provide care for themselves." Because
of this relationship, the nursing home has a duty, by law, to safeguard
its residents from the foreseeable consequences of his or her
impairment. This duty includes "taking
reasonable precautions to protect those who are unable to protect
themselves." Further, our courts generally
do not differentiate between foreseeable harms caused by potential
hazards at a nursing home, whether they be from physical conditions
within the home, or from visitors or staff. When
the nursing home fails to carry out its duty of care, a cause of action
can arise, entitling the injured party to recover damages.
Filing
a civil law suit in violation of the proper procedure or outside the
applicable statute of limitations can bar you from recovering any
