PERSONAL INJURY IN WASHINGTON

 

Personal injury law, or "tort" law, is intended to make one "whole" after they have suffered an injury caused by the negligence of another.   Negligence occurs when a person or entity with a duty to exercise care fails in that duty and, as a result of that failure, injury occurs. 

A personal injury lawsuit is brought on behalf of the plaintiff.   The plaintiff in a personal injury lawsuit can seek recovery for economic and non-economic damages.   Economic damages are the actual monetary loss suffered by the injured party.  Economic damages also include damages an injured party will suffer in the future as a result of their injury.  Non-economic damages include such things as pain and suffering, mental and emotional anguish and loss of enjoyment of life.

Personal injury actions can be time consuming and expensive.  Although most personal injury cases settle before trial starts, often times insurance companies won't really attempt to settle a case until just before trial begins.  Frequently, that occurs months or years after the original injury took place.
